OXFORD, Miss. (WCBI) -The suspect involved in a fight with a security officer at an Ole Miss game did not make a court appearance Tuesday morning, because of new legal developments in the case.
Attorneys for Chris Barnes say they found out Tuesday morning that their client is facing a felony assault on a police officer charge.
Barnes was set to appear in Lafayette County Justice Court to face charges of public drunkenness, disorderly conduct and resisting arrest.
The charges stem from an incident at the Ole Miss – LSU game when Barnes was accused of throwing a cup or other object at a spectator.
Cell phone video of the incident, which has been widely circulated on the internet, shows Barnes in a scuffle with security guards, called to investigate the incident.
Barnes claims he was assaulted by Brock White, a New Albany police officer, who was hired to work security at the game.
“I’m not sure how the felony came about, whether it came about simultaneously, or whether the police officer who assaulted our client, after the incident, it appears on the same day he swore out an affidavit against our client claiming our client hit him.”
The affidavit claims Barnes grabbed Officer White’s collar, then pushed him with his elbow.
Attorneys for Barnes say their client will plead not guilty on all charges.
