STARKVILLE, Miss. (WCBI) — The owner of Club Rock in Oktibbeha County had his day in court Tuesday morning. Club Rock has been closed since April after a shooting took place there. The Oktibbeha County Sheriff’s Department decided it was time to put an end to the heavy traffic and shootings near Club Rock. Now a judge has made a ruling in the case.
Club owner Larry Fair appeared at the Oktibbeha County Courthouse Tuesday morning to find out the fate of his night club business. A temporary restraining order was issued at Club Rock after five people were shot, one critically, in the early morning hours of March 29th.
David Daniels is Larry Fair’s attorney.
“My client is, just as law enforcement, concerned with no more shootings going on and certainly whoever committed these crimes my client wants brought to justice,” says Daniels.
Sixteenth Circuit Court Judge James Kitchens ruled that the club temporarily remain open but for church groups only. No alcohol or firearms are allowed on the premises. The Sheriff’s Department must also be notified prior to any event.
“The matter happened on his property but after hours, after the business is closed and we intend to take all measures to make sure that never happens again,” says Daniels.
Judge Kitchens also ruled that the case will be transferred to Chancery Court for further review. Fair’s attorney, says they’ll have no problem following the Judge’s orders.
“It’s just a temporary matter. These measures will only go on until the final hearing,” says Daniels.
No date has been set for the next hearing. Though the business will be in limited use for now, Fair could still be facing a civil suit from those injured in the March 29th shooting.
