Tishomingo Co. man’s Life Sentence stands after court rules against him
TISHOMINGO COUNTY, Miss. (WCBI) – A Tishomingo County man’s Life Sentence stands after a State Appeals Court rules against him.
Brian Berryman was sentenced to life in prison as a habitual offender after he was convicted in June 2020 for being a felon in possession of a firearm.
Berryman was arrested and charged in February 2017.
Berryman appealed the sentence, saying his Constitutional right to a speedy trial was denied because of the 3 year gap between his arrest and trial.
A majority of the seven judges on the Mississippi State Court of Appeals ruled that the delay did not harm Berryman’s ability to offer a defense.
Berryman’s previous convictions included murder and armed robbery.
