Video: Indictments Issued In West Point Assault Case, One Man Cleared

WEST POINT, Miss. (WCBI) — Two men have been indicted by a Clay County grand jury on aggravated assault charges related to an alleged beating that left a man in a coma after he was found in a West Point parking lot in August.

A third man is being sought but a fourth person originally charged in the highly-publicized case that drew national attention was not indicted by the grand jury.

Clay County District Attorney Forrest Allgood says no trial date has been set in the case for 21-year-old Marquavious McMillian of Aberdeen and 23-year-old Courtez McMillian of Okolona. Each is being held on $250,000 bond.

The charges stem from an incident that took place Aug. 23, 2014, at the Huddle House parking lot in West Point. Authorities say 32-year-old Ralph Weems IV, a U.S. Marine Corps veteran, was beaten.

Weems continues to recover at an Arkansas medical rehabilitation center.

“The victim in this case was severely injured. He probably will never be the same as a result of it. It is a tragic case for a lot of reasons,” Allgood said of Weems.

The McMillian brothers were the first arrested in the case. A third man, 22-year-old Constance McFarland of Aberdeen was arrested November 19, but the Grand Jury did not return an indictment in the case. Investigators familiar with the case said the evidence showed he was involved in the verbal dispute among the groups but not in the assault.

The grand jury did return an indictment against another man but his name or hometown won’t be released until he is arrested.
