Aggravated Assault Charge Upgraded To Murder In Waffle House Shooting

TUPELO, Miss. (WCBI) – An aggravated assault charge is upgraded to murder after the victim of a shooting at a Waffle House dies.

Nicholas Pack is now charged with one count of murder and one count of aggravated assault.

On Sunday, June 11, at around 2:30 AM, Pack opened fire inside a Waffle House on South Gloster St. in Tupelo. That shooting left two people injured. One of the victims,  30 year-old Mackenie Smith,  died Wednesday.

Investigators say he was shot four times and was the intended target. Police believe the second victim was an innocent bystander.

The case will be presented to the next grand jury term.

On Tuesday, June 13, Judge Sadie Hopkins set Pack’s bond at $3 million. It’s unclear if his bond will now be revoked, or a new bond set, due to the upgraded charge of murder.
