Shumpert Civil Case To Move Forward

ABERDEEN ( WCBI) – The civil case against Tupelo Officer Tyler Cook, Mayor Jason Shelton, Police Chief Bart Aquirre and the city will move forward.  Judge Sharion Aycock Tuesday denied the city’s request to delay the civil case until a possible Department of Justice investigation into the case is complete.

The DOJ says it is aware of the Shumpert shooting but has not said it is formally launching an investigation.  In her ruling, Aycock says there is no indication Officer Cook and others would suffer substantial prejudice if the two cases move through the courts at the same time.  The ruling now clears the way for the federal courts to begin setting trial dates and other deadlines in the case.   Shumpert’s widow Peggy is suing for $35 million in damages for wrongful death in connection with his June shooting following a police chase in Tupelo.  Shumpert was a passenger in a car which was stopped by Tupelo Police. He fled the stop and was found hiding under a home.   Shumpert was shot to death when he and Cook struggled.  The case was presented to a grand jury which declined to file any criminal charges against Cook.
