Jury Finds Clark Guilty Of Second Degree Murder, Not Capital Murder
FULTON, MISS. (WCBI) – A jury has returned a verdict in the second capital murder trial of a man accused of killing his four month old baby eight years ago.
This evening, the Itawamba County jury found Joshua Clark not guilty of capital murder, but found him guilty of second degree murder.
Clark plead to capital murder charges in 2010, in connection with the murder of his four month year old child, Kylie.
However, Senior Circuit Court Judge Thomas Gardner vacated that plea, on the grounds of ineffective counsel and a new trial was ordered.
Clark was facing life in prison under his original plea. Now, he could get anywhere from 20 to 40 years in prison. Judge Gardner will sentence Clark at a later date. The eight years he has served will be taken off of any sentence.
