Absentee ballots dispute on hold

BROOKSVILLE, Miss. (WCBI) – A challenge to the Brooksville mayor’s race is on hold until 2019.

David Boswell was elected mayor in 2017.

But the challenger Earlier Henley, Jr. is contesting absentee votes.

Henley’s counsel rested their case this week in Noxubee County Court.

A future hearing to present Boswell’s case is expected to happen in January or April.

Noxubee County has a chancery court term in February and circuit court is there in March.

The court administrator is tasked with finding five days in a row that work for all parties, along with an available courtroom prior to setting the next date.

Earlie Henley Jr. is challenging the 119 absentee ballots cast in the 2017 election. Boswell received 111 of those votes, while Henley got eight.

The Brooksville Democratic Executive Committee is named in the complaint, along with Boswell.
